PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. By using this site, you signify your agreement to these Terms and Conditions. If you do not agree to these Terms and Conditions, do not use this site. We may modify these Terms and Conditions at any time.
This site is copyright protected. Any textual or graphic material you copy, print, or download is property of 'Color Dach' and for your personal, non-commercial home use only. You are not allowed to change or delete any copyright, trademark or other proprietary notices.
§ 1 General
The following Terms and Conditions apply to all offers, contracts, supplies and other services. Hereby, we disagree explicitly with differing rules to the contract by the other party.
§ 2 Date of contract
By submitting the order when clicking the button, you place a binding order in the cart of goods. The confirmation of the order follows immediately after placing your order into the cart and submitting the order. The contract of purchase comes with our delivery confirmation or the delivery of goods.
§ 3 Offers
All offers are non-binding. All orders require the written or telex confirmation and acceptance of the seller. By placing an order the customer makes a binding intent to purchase the goods ordered.
§ 4 Look at the contract text
The contract will be saved. You can view the general terms and conditions on Colordach.info at any time and save on your computer. The actual order and the General Conditions will be sent via e-mail and can be viewed in the login area when you are logged in.
§ 5 Return Policy
Right of revocation
Because all goods are custom-made we cannot accept returns.
Sole excepition:
If you receive a defect product, send us a picture of it via e-mail. You do not have to return the defect product, only if we need the damaged product for the insurance.
In this case you will receive an e-mail from us with further instructions. You will also be reimbursed for the return shipping costs.
If you do not send the photo, you cannot get replacement.
§ 6 Warranty
The warranty is subject to legal regulations.
§ 7 Delivery and payment
The delivery and payment terms of "Colordach" are in the purchase order form. There is no minimum order size. Special delivery forms requested by our customers are calculated using local supplement.
To find out the estimated delivery time, please refer to the product description. It is possible to have extended delivery times at your request.
Please check the goods upon delivery by the deliverer (parcel, postman) for visible damages to the packaging, or other abnormalities. If this claim is the case, you direct the deliverer when receiving the package.
Since the shipment is usually insured, we can only log shipping damage if the damage was claimed at delivery.
We are entitled to partial deliveries to a reasonable size for you. There will be additional shipping costs only with an explicit agreement.
Prices are ex works. Packaging, freight, duties, incidental charges and other fringe benefits are calculated separately. Next to the prices you will have to pay value-added tax at the statutory level.
Packaging will be property of the purchaser and charged by the supplier. Postage and packing charges will be billed separately. The method of shipment will be chosen at our discretion.
If the service is not available through no fault of our own, consumers will be informed immediately and may have already provided with compensation payment.
§ 8 Remuneration
The purchase price is binding. The customer agrees to pay the goods of the order within 10 days of the purchase. After this period the customer is in default of payment. The costumer has to pay interest on defaulted debt at the rate of 5% above the base rate.
§ 9 Retention of title
Until full payment the goods remain the property of "Colordach".
§ 10 Limitation of Liability
The company "Colordach" is only liable for other damage than loss of life, body and health damage, if these damages are based on an intentional or grossly neglected act or a negligent breach of a contractual obligation by the company "Colordach" or its agents. Any further liability for damages is excluded. The regulations of the Product Liability Act remain unaffected.
Given the current state of art, data communication via Internet cannot be guaranteed to be free from errors and / or be guaranteed at all times. The boutique is not liable for the permanent availability of "Colordach".
§ 11 Privacy Policy
We use your personal data only to process your order. All data of the customers will be stored and processed in compliance with the relevant regulations of the Federal Privacy Act (Act) and the Telemedia Act (TMG).
Your data is secured while shopping in our store using SSL 128th. With a subscription to the newsletter we store your e-mail address for purposes of advertising and market research until you unsubscribe from our newsletter via e-mail.
We would like to point out, that you can cancel your given consent at any time with effect for the future.
You always have a right of free information, correction, blocking and deletion of your stored data. Please contact us by e-mail to: support [at] colordach.info or send us your request by mail or fax. Please do not try to contact us via phone, since our german company is so small, we cannot afford an interpreter to speak with you on the phone. We have no problem with understanding and answering you in written English but to avoid misunderstandings we would like to ask you to just write us ;-) because our spoken English is not that good,unfortunately .
We do not share your personal information including your home address and e-mail address with third parties without your explicit and revocable consent. Excluded from this are our service partners, who need your data to process the order (such as the staff responsible for the shipping company and the staff responsible for processing payments). In these cases the amount of transferred data is reduced to the necessary minimum. Your concerns are taken into account under the law.
Cookies
The website uses cookies in several places. They serve to make our service more user-friendly, effective and safer. Cookies are small text files that are stored on your computer and stored by your browser. Most of the cookies we use are "session cookies". They are automatically deleted after your visit. § 12 Jurisdiction
Performance and jurisdiction for both parties is based on the location of "Colordach" if the customer is a merchant, legal person of public law or public law special fund. Only the law of the Federal Republic of Germany is in effect.
